These Terms of Sale apply to products purchased directly from Michael E. Kappler through The Adventures of Abby the Tabby, including qualifying website and in-person direct sales. Purchases made through Amazon or another independent retailer are governed by that retailer's terms and policies.
Adult Purchasers
The commercial, checkout, payment, customer-service, personalization, and mailing-list portions of the website are intended for adults. By placing an online order, you represent that you are at least 18 years old or otherwise legally able to enter into the transaction. Children should not independently submit payment information, mailing addresses, email addresses, personalization requests, or other personal information through the website.
Products
We make reasonable efforts to describe our books and other products accurately. Printed colors, screen colors, dimensions, packaging, signatures, and other physical details may contain reasonable variations. Signed books may contain natural variations in an author's handwritten signature.
Prices
Prices are stated in U.S. dollars unless otherwise indicated. Prices, bundles, offers, shipping promotions, and product availability may be changed prospectively. Changes will not ordinarily affect an order that has already been accepted and paid, except when necessary to correct an obvious error or when otherwise permitted or required by law.
Website Payment Processing
Payment is due at checkout. Website credit-card and supported digital-wallet payments are processed through Stripe. Stripe receives and processes the payment information required to authorize and complete the transaction. The Adventures of Abby the Tabby does not intend to store customers' complete payment-card numbers in its Cloudflare order-management system. Stripe's handling of payment information is also governed by Stripe's own applicable terms and privacy notices.
In-Person Payment Processing
Qualifying in-person credit-card, debit-card, and supported digital-wallet transactions may be processed through Square. Cash and Zelle may also be accepted for qualifying in-person direct sales.
Square and applicable banks or payment services may process information necessary to complete those transactions under their own terms and privacy practices.
Sales Tax
Applicable sales tax may be calculated and collected based on the order, product, purchase location, shipping destination, applicable law, and our tax obligations. The amount of applicable sales tax, when collected, will be included in the customer's transaction total.
Order Acceptance
An automated order confirmation does not necessarily constitute final acceptance if there is:
- a payment problem;
- an obvious pricing or technical error;
- suspected fraud;
- unavailable inventory;
- an invalid or undeliverable shipping address; or
- another circumstance preventing lawful or reasonable fulfillment. If we cannot accept or fulfill a paid order, we will provide an appropriate refund.
Inventory and Availability
Products are offered subject to availability. If an item becomes unavailable after an order has been placed, we will contact the customer regarding available alternatives, delay options, or cancellation and refund.
Personalization
Customers are responsible for entering personalization information accurately. Please review spelling, names, capitalization, wording, and other instructions carefully before submitting the order. We may decline a personalization request that is unlawful, threatening, abusive, discriminatory, obscene, infringing, or otherwise inappropriate. If a personalization request is declined and an acceptable alternative cannot be agreed upon, the affected order will be canceled and refunded.
Shipping and Delivery
Shipped direct orders are governed by the Shipping Policy. Customers are responsible for providing an accurate shipping address. Carrier delivery times are estimates unless expressly guaranteed.
Returns and Refunds
Returns, refunds, replacements, cancellations, personalized-item restrictions, and damaged-product procedures are governed by the Returns & Refund Policy.
Fraud and Unauthorized Transactions
We may use fraud-prevention and security tools supplied by Stripe, Square, Cloudflare, financial institutions, and other service providers. We may delay, decline, or cancel a transaction when we reasonably believe that it is fraudulent, unauthorized, unlawful, or presents a significant security risk.
Intellectual Property
The Adventures of Abby the Tabby, its books, illustrations, characters, written content, logos, website materials, and associated creative works are protected by applicable intellectual-property laws. Purchasing a physical book or other product does not grant or transfer copyright, trademark, reproduction, adaptation, merchandising, licensing, or other intellectual-property rights in the books, characters, illustrations, text, logos, or associated creative materials.
Website Errors
We may correct typographical mistakes, inaccurate descriptions, pricing errors, technical errors, or other website mistakes. If an error materially affects an order that has already been placed, we will contact the customer and provide an appropriate option to continue with the corrected order or cancel the affected order.
Applicable Law
These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise. Nothing in these Terms limits consumer rights that cannot legally be waived or restricted.
Changes to These Terms
We may update these Terms from time to time as the business, website, technology, products, or applicable requirements change. The version in effect when an order is submitted will generally govern that transaction.
